In Vermont, Effort Targets Shaken Baby Syndrome | Shaken Baby Syndrome Attorney


Bob Logan’s infant grandson died nearly eight years ago on Father’s Day, two days after being violently shaken by his teenage father. Now, the grieving grandfather wants to help teach other young parents how to avoid the same pain.

“The alternative would be to remain angry for the rest of my life,” Logan said. “So I thought a better alternative would be to help prevent this.”

Regardless of official school colors, purple soon will become more prominent at some New Hampshire high schools as part of a project to educate teens about injuries associated with shaking infants.

“The Period of PURPLE Crying for Teens” builds on a national program aimed at reassuring new parents that it’s normal for babies between the ages of two weeks and four months to experience long bouts of inconsolable crying. Purple is an acronym that describes characteristics of an infant’s crying during this phase — peak of crying, unexpected, resists soothing, pain-like face, long lasting and evening.

New Hampshire hospitals and others across the country have been sending new parents home with brochures, DVDs and tiny purple hats to reinforce the message for years, but the new project marks the first time teenagers in the state are being specifically targeted.

Casey Anthony verdict impacting prosecutions for shaken baby syndrome| Shaken Baby Syndrome lawsuit

The casey Anthony trial and verdict has re-focused attention on the level of crime with which prosecutors charge defendants. It has been widely-reported that the jury in the Anthony case may have had enough evidence to convict of lesser charges, but not for first degree murder. Prosecutors, being both public servants and elected politicians, are both required to not over-charge a defendant and conscious of the effect of a highly-publicized loss on their record when they run for re-election. The ripple effect from the Florida verdict in the Anthony case has made its way to Iowa - where a prosecutor has downgraded charges from capital murder to negligent homicide in the case of Suzanna Harwell and Brandel Harwell, her deceased 6 month old son. Among all the studies and experts who have opinions regarding the pathophysiology and biomechanics of shaken baby syndrome and abusive head trauma, it is important to also keep track of what the people involved in the incident report occurring. In Australia, it was recently reported that a young father admitted to shaking his 17 days old infant in an attempt to quiet her because she was crying. It was reported that he became frustrated, shook her 3-4 times before she went limp and her lips turned blue. The father, to his credit, immediately called 911 and she was taken to the hospital where it was discovered she had catastrophic brain injuries. He reportedly "snapped" and was shaking her "vigorously". He reportedly pled guilty to manslaughter.

Domestic violence linked to child abuse|Child abuse lawyer|Shaken Baby Syndrome Survivor Lawyer

Domestic violence (DV), which is also known as Intimate Partner Violence (IPV) or Intimate Partner Aggression or Violence (IPAV), creates an increased risk of corporal punishment of children, which is known to create an increased risk of physical child abuse. According to a recently published study, "Use of Spanking for 3-year-old Children and Associated Intimate Partner Aggression or Violence" by Catherine Taylor, Ph.D., Shawna Lee, Ph.D., Neil Guterman, Ph.D. and Janet Rice, Ph.D., published in Pediatrics, Vol. 126, Number 3, a significant finding in their study was that adult VICTIMS of domestic violence (DV)/ Intimate Partner Violence (IPV)/Intimate Partner Aggression and Violence (IPAV) have an increased probability of using corporal punishment with their children. This is an important finding for those investigating child abuse cases when trying to determine the likely perpetrator of child abuse. It has already been established in published literature that there is an increased likelihood that a person who uses corporal punishment on a child would also abuse a child. Therefore, in homes where domestic violence is present, we now have published literature demonstrating a causal link between domestic violence and child abuse, via the connecting link of corporal punishment. Domestic leads to increased risk of corporal punishment, which leads to increased risk of child abuse.

The authors explain that there is statistically significant evidence that a victim of domestic violence is likely to inflict abuse on a child. Why? They offer two (2) explanations: Coercive Family Process (known as Patterson's theory) and Social Cognitive learning (Bandura's theory). The coercive family process is explained by the authors as an escalation of violence which occurs due to positive reinforcement after aggressive events. The social cognitive explanation is based on the normalization of observed behavior. Meaning, more specifically, that adult victims of domestic violence learn that violence is "normal" in her environment, and is part of what the authors describe as an "intrafamilial cycle of aggression" The authors demonstrate and highlight that an adult victim of domestic violence has increased odds of using corpoporal punishment.

While it would be easy to see, from a lay person's perspective, how the aggressor in an abusive adult relationship might be suspected to be the most likely person to inflict physical abuse on a child, this study confirms that is NOT necessarily the case.

In my opinion, if you are investigating a case where a child has been shaken or suffered abusive head trauma, it is critically important to determine whether there is domestic violence in the home or homes where the child has been left alone with adults. While most child abuse occurs when children are alone with the perpetrators, and children are too young to testify about what occurred to them - domestic violence is more likely to be witnessed and, by definition, there will be an adult victim who can testify that it occurred. Along with the medical evidence as to the likely time an injury was inflicted, and the importance of history related to the presentation of the abused child at the time medical care was begun, the presence of domestic violence is one more important piece of evidence which can and should be used to determine the likelihood of someone being a perpetrator of child abuse.

Virginia jury hears both sides of shaken baby syndrome debate - decides in favor shaken baby syndrome in Noah Whitmer case - Keane Law Firm raises awareness of shaken baby syndrome and its effects on families

In January, a Virginia jury which reportedly heard both sides of the shaken baby syndrome debate convicted a daycare provider of felony child abuse and child cruelty for injuries consistent with shaken baby syndrome suffered by Noah Whitmer.  The jury then sentenced the daycare provider to ten (10) years in prison.  It is reported that the daycare provider will appeal.

5-Week-Old Boy Hospitalized for Shaken Baby Syndrome, 19-Year-Old Father Arrested

A 19-year-old father from Missouri was arrested after his infant was found with bleeding of the brain and other injuries caused by shaken baby syndrome (also called abusive head trauma), according to the NWA online website.  The 5-week-old boy was hospitalized Saturday at St. John’s Hospital in Springfield and was reported to be in critical condition after his mother observed that he was experiencing difficulty breathing and took him to Mercy Medical Center.

According to the article, father Zachary Campbell told police that he was stressed from lack of sleep caused by the infant's crying.  He reportedly told investigators that he shook his son because the baby was crying.

Rural Areas May See More Cases of Shaken Baby Syndrome, Says Child Abuse Prevention Expert

We have posted news here on the Shaken Baby Syndrome Blog about the link between economic troubles and increased instances of shaken baby syndrome.  According to child abuse prevention expert Leah Wohlsdorf, there is also a strong correlation between rural areas and cases of shaken baby abuse, also called abusive head trauma due to the extensive amount of trauma to the head that occurs when a baby is shaken.  As the executive director of Prevent Child Abuse North Dakota, Wholsdorf reported to The Bismark Tribune that situations in rural areas can lead to an escalation in instances of abusive head trauma.  According to the Tribune, the correlation exists because isolation, which often occurs when people live great distances from each other and houses are miles apart, can lead to increased stress and, as a result, abuse during frustrating times.  It can also become more difficult to stay calm when a baby cries if there is no one else around to help or give a break to the primary caregiver.

Prevent Child Abuse Organization Receives Grant for Simulator Dolls Aimed at Shaken Baby Prevention

In the midst of economic troubles, organizations in Georgia are thankful to be the recipients of grants from the Coweta Community Foundation, some of which will help in shaken baby syndrome prevention, according to the Times-Herald online.  The mission of the foundation is to provide grants to a variety of causes that will better the quality of life for local residents.  Among those charitable causes is shaken baby syndrome (also called abusive head trauma) prevention.  Specifically, Prevent Child Abuse (PCA) Coweta was given $1,000 to purchase three dolls that simulate how abusive head trauma affects a child's brain.  The simulator dolls will be placed in three separate Coweta County high schools in an effort to educate students and the local community on the serious dangers of baby shaking.  Grant money to the organization has already aided in the purchase of educational DVDs aimed at shaken baby prevention, as well.

New Study Finds That Many People Guilty of Child Abuse Get "Off the Hook" in Court | Shaken Baby Syndrome Attorney

A new study has found that many people charged with child abuse for shaking babies and causing serious head injuries to children are "let off the hook" in court, according to MedIndia online.  The article reports that Dr. Amanda Stephens examined the cases of 68 children who received treatment for shaken baby syndrome in the child protection unit at Sydney's Children's Hospital at Westmead.  Upon examination of these cases, which occurred between 1997 and 2005, Dr. Stephens concluded that perpetrators are often "let off" due to the difficulty of identifying them.  In her own words, "if you don't know who did it" and cannot "make that decision," it can be extremely difficult to determine "whether that child should be returned to the family" or removed from the family.

The mother of a baby boy who was allegedly shaken by a stepfather or another caregiver is being investigated by the Department of Children and Families, according to the News-Press website.  Although the mother was not the one arrested in connection with the serious head injury suffered by the 8-month-old boy, she is being questioned about the incident of shaken baby syndrome.

Boyfriend of Child's Mother Confesses After Baby Dies of Shaken Baby Syndrome

A 39-year-old man from Hollywood, FL, recently confessed to shaking his girlfriend's 11-month-old baby to death in June 2009, according to the Orlando Sentinel.  According to police, Cecil Weekes has been charged with murder in connection with the incident of shaken baby syndrome that occurred three days before young Angeliah Duncan's death.  Weekes and the baby's mother were reportedly home when the child began to cry uncontrollably, leading to the Hollywood man's frustration and the tragic incident.  Angeliah was pronounced dead June 15th at Memorial Regional Hospital, and an autopsy confirmed that her fatality was a result of shaken baby syndrome.

Child Abuse & Shaken Baby Cases Rising in Weakened Economy | CA Abusive Head Trauma Lawyer

Police in the metropolitan Las Vegas area have recently found that the number of child abuse cases in Clark County, NV, have risen 17 percent this year, according to Fox 5 News Las Vegas.  According to the news channel, Metro Lieutenant Ray Steiber attributes the increase in broken bones and shaken baby syndrome at least partly to the nation's economic situation, which puts stress on families due to the loss of jobs, difficulty paying bills, and other hardships.  In the year 2008, police in metro Las Vegas responded to nine cases of shaken baby syndrome total.  This year, they have already handled seven cases of shaken baby syndrome (from January through July).  In response to the devastating trend this year, the police department set a child abuse prevention program in motion in April.  The "Just Step Back" program is similar to prevention efforts in other states in that it partners with local hospitals to educate parents of newborns before they take their children home.  Like many other programs, the Las Vegas effort uses a video to demonstrate the dangers of shaking or abusing a baby.

NY Man Charged After CT Scan Reveals Infant's Injuries Consistent With Shaken Baby Syndrome

A 26-year-old New York man was recently charged by police with child endangerment and reckless assault for allegedly shaking a 10-month-old baby on the Fourth of July, according to the Buffalo News website.  Clarence, NY, resident Jordan Mayne was reportedly at his girlfriend's home when he heard the infant crying and went to the baby's room to check on him.  After realizing that the baby was not acting normal when he was fed a few hours later, the infant's mother took him to his grandmother, who called 911.  Upon administering a CT scan to the baby at Women & Children's Hospital, a doctor reported that the scan revealed injuries consistent with shaken baby syndrome (abusive head trauma).  The baby was said to be improving at the time of the report.
