Why, the Keane Law Firm? | Shaken Baby Syndrome

Most attorneys and law firms that you will find on the internet are interested in defending people accused in a criminal case of shaking a baby.
Not the Keane Law Firm.
We are here to represent the baby, not the criminal defendant.
Chris Keane and the Keane Law Firm help shaken babies and their families to recover money in civil court so that they can have the financial resources available to hire the attendant care help and rehabilitation services which they will need to live the remainder of their lives.
This does involve taking money from the person who shook the baby and those who could have prevented it in order to correct the injustice that was done to the shaken baby, and the Keane Law Firm is very familiar with the processes involved in civil Shaken Baby cases.
Civil lawsuits involving shaken baby syndrome will focus on a number of different issues than criminal cases. Civil lawsuits focus on issues of negligence, not crimes.  That means that it is never necessary in a civil negligence case to prove that someone "intended" to injure the baby,  only whether a person or employee failed to use reasonable care in handling a baby.
A person charged with criminal child abuse for allegedly shaking a baby may be successful in avoiding a criminal conviction for a number of reasons, but that doesn't mean that he or she should be held responsible, or liable, to your baby in a civil case because a civil jury may find that the person unintentionally orcarelessly failed to use reasonable care in handling your shaken baby.
Also, there will be no need to prove "beyond a reasonable doubt" who shook the child. A term called "preponderance of the evidence" comes into play in civil cases. This legal term is defined as "more likely than not", meaning that the person sued in a civil lawsuit was the person who shook the child.
Here's an example: A prosecutor or district attorney may choose not to proceed with a prosecution because she feels that she simply cannot prove "beyond a reasonable doubt" that the person arrested for shaking the baby was the person who did it.  That may be due, in part, to an inability to prove a precise time at which the injury was inflicted. Maybe the treating physician didn't have the knowledge to be able to provide such an opinion, or maybe the prosecutor or district attorney's office was unable to hire an expert physician for financial reasons.
While this may be discouraging to you as a parent, guardian, or family friend of the shaken baby, don't worry because you can still do something to help the shaken baby.  You do not need a criminal prosecution in order to file a civil lawsuit on behalf of the shaken baby.   Whether your local prosecutor or district attorney prosecutes a person successfully, or not, is not important to The Keane Law Firm.
We can represent a shaken baby in civil court even if a criminal defendant is found not guilty, or if a prosecutor does not go ahead with a trial.
Also, unlike the prosecutor or district attorney, The Keane Law Firm is not limited to calling only the treating physician or coroner/medical examiner as a witness to prove the timing of the shaken baby injury. We can hire some of the top physicians in the country to prove the timing of the injury.
The Keane Law Firm is not constrained by the same financial budgets as a prosecutor or district attorney.  We retain the top experts in the country to work on a shaken baby syndrome case, and will do the same for your shaken baby.
If you have any questions or concerns about what can be done to help babies who have been shaken, or families of babies who have died, please call Christopher Keane and The Keane Law Firm toll-free for free consultation at (888) 592-5437 (KIDS), click on contact us here, or use the web form provided at http://www.keanelaw.com

{October Family Spotlight} Xaviers Awareness

Mr. and Mrs Rudy Delgado - Approx 4 years ago

On June 9, 2007, Melissa was preparing to become Mrs. Delgado, as she married her best friend and soul mate Rudy Delgado.  With a beautiful, elegant wedding joined by friends and family, 2 families soon became one.  Such a beautiful happy time in their lives they shared with all those they love so dearly.

Today, Rudy and Melissa have been married for almost 4 years, they have 3 sons, Braydon 13, Marcus 8, and Xavier, who would be turning 3, and Baby llyssa who is set to make her first debut December 4, 2011.

The Delgado Family - First Family Picture - Xavier, 6mo.

Since September, 2009 thousands have come to know Xavier Delgado as "X" a fighter and Hero, whose life ended far too soon. From the sweetest of moments, Xavier's laugh, his kisses, and the love he continues to give, not a single moment ever goes un-noticed. His smell, his touch, his "coos", his babbles, every gesture any 6 month old could make, are forever instilled in the hearts of the Delgado Family.

[/caption]

Rudy came into contact with Christopher Keane in Atlanta, Georgia in 2010 at the National Conference on Shaken Baby Syndrome, exchanging phone numbers, they have remained in contact since.

The Mission of Xaviers Awareness is to make sure everyone knows Xaviers story, and to raise awareness in his honor.  In doing so, they host a few events each year that gather hundreds of supporters to honor a life lost far too soon.

They host the Annual Xavier Delgado Walk for Awareness/X Games and from the events, funds are raised for the foundation to help them further their goals to prevent SBS. One of those goals has been reached as a commercial was made in recognition of Xavier in his Memory.

The Delgado Family also hosts an Annual B.Y.O.B (Bring Your Own Balloon) ANGELversary balloon release on September 29th every year to honor Xavier.

One of the goals the Delgado Family has for Xaviers Awareness Foundation is to have a law passed Nationwide to watch a video on Shaken Baby Syndrome and to sign a promise contract when they have a child to prevent Shaken Baby Syndrome.

Through the many many good things the Delgado Family plans to do in honor of Xavier to carry on his Legacy, there are many moments of depression, many moments of anger and confusion, and many moments asking why, why did this have to happen to Xavier? Rudy expressed the great power the love his family continues to give to him and the out pouring support for Xavier and their family pushes them through the motions each and everyday. Pieces of each of their hearts vanished when Xavier passed away.

Xavier wearing Daddy's Father's Day Present

If there was one thing Rudy truly wishes he could do in Xaviers Honor, Rudy would like to speak with the President, to express the necessity for the laws for those whom have injured our children to be reviewed and much more strict to protect our children.  Rudy states, "Shaken Baby Syndrome needs to be brought to the fore front, and not to be hidden any longer! Shaken Baby Syndrome is 100% preventable, and until we open up everyone's eyes, on the harsh reality of Shaken Baby Syndrome, nothing is going to change."

The two greatest occurrences in the past 2 years that have truly helped Rudy and Melissa go through the motions of SBS have been the National Conference on Shaken Baby Syndrome and the Shaken Baby Syndrome Candlelight Vigil.  At both events, they were able to spend time and meet with families that have been through comparable situations concerning Shaken Baby Syndrome, who knew to a degree what they were going through, and what they will have to go through in the future.

Shaken Baby Syndrome Awareness Ride and Poker Run

Recently, Chris received a Certificate in the mail for sponsoring the 2nd Annual Shaken Baby Syndrome Awareness Ride and Poker Run hosted by A.R.M. Chapter #69 and we had the amazing chance to interview Kim recently on the success of this event! Keane Law is a proud sponsor of this event, and would like to introduce you to an amazing woman, Kim Morelock!

Kim has been married to Denny Morelock for 25 years, and have 3 beautiful children, and a beautiful Grandson and love of their life, Dominic.  Dominic is only 4 1/2 years old, but he knows he was shaken by a "bad man". Dominic has had seizures on a daily basis, but those are now controlled with medication that he continues to take twice a day.  In the beginning, he would have nightmares and wake up at all times of the night screaming and crying.  Most of the time it would take several hours to get him calmed down.  Dominic does not like the lullaby Rock-a-by-Baby, he says "the monster that shaked me sang the song and I don't like it". Dominic has now began school, and is having hand eye coordination problems, related to the brain injury.

Kim originally came in contact with the Shaken Baby Syndrome Support Network, before the name was in place, in 2007.  Kim found Kaleb Schwade's profile on MySpace that gained National attention, from the moment Kaleb was injured.  From there, Kim would go on to research and find Madilyne Wentz, daughter of Rachel Sumner.  Kim began talking frequently with Rachel, reading her blogs, and understanding that through this horrific act of Shaken Baby Syndrome, she was not alone. Kim went on to find numerous other grandmothers, mothers, sisters, aunts, and so on, dealing with similar circumstances with Shaken Baby Syndrome.

Denny Morelock originally came into contact with Chris Keane while searching the internet concerning Shaken Baby Syndrome, in hopes of finding a sponsor for his race car he previously owned, to get it back on the track and Race for Awareness of Shaken Baby Syndrome.  He began talking to Chris, and ever since, Keane Law Firm has been a silent Sponsor on the race car.  Kim learned of Chris through Denny, however, was able to make arrangements for Chris to attend and speak to hundreds of families affected by Shaken Baby Syndrome at the 5th Annual Shaken Baby Syndrome Candlelight Vigil in Sarasota Florida April, 2011.
Kim is now serving as President on the Board for the Shaken Baby Syndrome Support Network (http://www.shakenbabysupport.com) and has been working for 2 years now with the A.R.M. Chapter #69 Group in Ohio to host the Annual Awareness Ride and Poker Run.

On September 17, 2011, Kim and Denny Morelock organized the 2nd Annual Awareness Ride and Poker run, hosted by .A.R.M. Chapter 69! .A.R.M. stands for Association of Recovering Motorcyclists.  All of the members of this Chapter 69 are recovering from the use and/or abuse of drugs and/or alcohol.  There are a very loving and generous group of people, that greet you with a hug no matter if it is the first time they have met you.

Kim stated, "My greatest gift is being able to look into the eyes of my grandson and other survivors of SBS children and know I am helping to make a difference.  People are more "aware" of SBS because of what we do.  I have always been the neighborhood Mama, but since becoming part of the SBS Support Network, my neighborhood has grown.  Everyone knows me as Mama Kim and it warms my heart when I hear a complete stranger call me that!"

The Awareness Ride and Poker Run was twice the size as the first year, and will continue on an Annual basis!  Kim stated, if she could tell anyone any one thing about SBS, she would tell them.. "Never EVER Shake A Baby!! It Shatters Lives!"

Virginia jury hears both sides of shaken baby syndrome debate - decides in favor shaken baby syndrome in Noah Whitmer case - Keane Law Firm raises awareness of shaken baby syndrome and its effects on families

In January, a Virginia jury which reportedly heard both sides of the shaken baby syndrome debate convicted a daycare provider of felony child abuse and child cruelty for injuries consistent with shaken baby syndrome suffered by Noah Whitmer.  The jury then sentenced the daycare provider to ten (10) years in prison.  It is reported that the daycare provider will appeal.

Whether the appeal is successful or not, tragically, for Noah, the injuries which he has suffered will last a lifetime.   Shaken Baby Syndrome can and does cause irreversible brain damage.  In ten (10) years, the brain damage will not be gone, it will remain.  Shaken Baby Syndrome not only damages babies, it destroys lives - especially that of the family who must care for the shaken baby for the remainder of his or her life.  To read more about shaken baby syndrome and how it has affected one little boy and his family, go to www.noahsroad.com

As an advocate for injured and abused children, The Keane Law Firm supports the prevention of shaken baby syndrome.  If you need more information for a baby who has been shaken and who may be suffering from abusive head trauma, feel free to contact lawyer Chris Keane with any questions you may have.  The Keane Law Firm will provide you with free information and will help you acquire the resources your child needs to reach maximum recovery.  Contact Chris Keane online or call 1-888-592-KIDS.

Morelock Racing Team races to raise awareness of Shaken Baby Syndrome - join the Keane Law Firm in supporting him.

Denny Morelock, Sr., a race care driver and, more importantly, a grandpa - is combining his love for racing and his love for his grandson, Dominic.   Dominic is  survivor of shaken baby syndrome who was shaken at three (3) months of age.   It is the goal of Denny, and his family, to raise awarness of the risk of shaken baby syndrome - and how to prevent it.  He will accomplish his goal by taking his Morelock SBS Racing car to as many car shows, fairs and festivals as his schedule and financial support permits.  Additionally, the Morelock crew hopes to get a petition signed that requires each new parent to watch a  video about the dangers of shaking a baby before they leave the hospital with their newborn.   This is a  great cause, and Denny is a very determined and sincere grandpa.  The Keane Law Firm supports Denny and his cause, and if you can help his team out with a sponsorship of any size, contact him at Kmorelock@woh.rr.com.  Go Denny Go!

Teacher Awarded Grant to Purchase Shaken Baby Syndrome Simulator Doll

Thanks to a grant program established in her area, a high school teacher in Texas will be able to purchase a life-size doll that simulates the effects of shaken baby syndrome on a child's brain, according to the Times Record News.  Named the IDEA grant, the prize is awarded to 21 teachers at nine different campuses in the Wichita Falls Independent School District who have the best ideas for a creative classroom project or need.  Award recipients receive money to carry out creative project ideas or purchase the requested supplies for their classes.  The winning teachers not only receive a check to fund their ideas, but also a balloon bouquet and a sign to post outside their classroom that announces their win.

The importance of this teacher's project idea is key:  to illustrate the devastating (and even surprising) effects even minor shaking can have on a baby's brain.  If you would like more information on shaken baby syndrome or how it affects young children, feel free to contact abusive head trauma attorney Chris Keane.  As an advocate for injured and abused children, he will answer all your questions for free with compassion and professionalism.  1-888-592-KIDS.

Rural Areas May See More Cases of Shaken Baby Syndrome, Says Child Abuse Prevention Expert

We have posted news here on the Shaken Baby Syndrome Blog about the link between economic troubles and increased instances of shaken baby syndrome.  According to child abuse prevention expert Leah Wohlsdorf, there is also a strong correlation between rural areas and cases of shaken baby abuse, also called abusive head trauma due to the extensive amount of trauma to the head that occurs when a baby is shaken.  As the executive director of Prevent Child Abuse North Dakota, Wholsdorf reported to The Bismark Tribune that situations in rural areas can lead to an escalation in instances of abusive head trauma.  According to the Tribune, the correlation exists because isolation, which often occurs when people live great distances from each other and houses are miles apart, can lead to increased stress and, as a result, abuse during frustrating times.  It can also become more difficult to stay calm when a baby cries if there is no one else around to help or give a break to the primary caregiver.

No matter the cause of shaken baby syndrome, the condition is not to be taken lightly.  If you believe that your child or a child you know may be suffering from abusive head trauma, feel free to contact child injury attorney Chris Keane with your most pressing questions and concerns.  As an experienced shaken baby syndrome lawyer who works with the best medical experts in the field on a regular basis, he will answer your questions for free with compassion and professionalism.  For free resources, information on how you may pursue a case even if the caregiver did not intentionally harm your baby, or advice concerning your unique situation, contact Chris Keane online or by phone at 888-592-KIDS.

Family Skills Center Joins Abusive Head Trauma Prevention Effort, Provides Tips for Parents

Birmingham, Alabama's Exchange Club Family Skills Center has joined the abusive head trauma prevention effort, according to the CBS 42 news website.  The center partnered with other agencies in a child safety fair that included a display demonstrating the trauma that occurs in child's brain when it is shaken.  The shaken baby simulator is a doll with a clear skull so that viewers can see different parts of the doll's brain light up when shaking occurs.  The light highlights an area that suffers damage from the shaking.  What surprises many viewers is how quickly and easily the baby's brain is damaged; within three seconds, the baby may suffer damage to its eyesight, ability to feel normal emotions, or even fatal damage.  In order to help those who don't know what to do when their babies cry excessively, the center lists these tips (adapted here):

1. Rock or bounce your child gently in a steady motion, stand with your baby in front of a mirror, or walk around the room with him or her.

2. Use a noisemaker, such as a vacuum, ceiling fan, or running water, to tune out unwanted noises.

3. Put your child in a bouncy seat or take your baby for a ride in the stroller or car.

4. Sing or play soothing music for your child.

5. Massage your child on the head or forehead to soothe them.

6. If you feel as if nothing works and you've tried it all, understand that some babies (over 3 months old) need to cry for a while before they wear themselves out.  Let them cry if you know they are okay, and stay calm.

For more information on abusive head trauma or free answers to questions regarding your unique situation, contact Chris Keane online or at 888-592-KIDS.

Prevent Child Abuse Organization Receives Grant for Simulator Dolls Aimed at Shaken Baby Prevention

In the midst of economic troubles, organizations in Georgia are thankful to be the recipients of grants from the Coweta Community Foundation, some of which will help in shaken baby syndrome prevention, according to the Times-Herald online.  The mission of the foundation is to provide grants to a variety of causes that will better the quality of life for local residents.  Among those charitable causes is shaken baby syndrome (also called abusive head trauma) prevention.  Specifically, Prevent Child Abuse (PCA) Coweta was given $1,000 to purchase three dolls that simulate how abusive head trauma affects a child's brain.  The simulator dolls will be placed in three separate Coweta County high schools in an effort to educate students and the local community on the serious dangers of baby shaking.  Grant money to the organization has already aided in the purchase of educational DVDs aimed at shaken baby prevention, as well.

Not only is it helpful for organizations to receive grants like this in the midst of difficult economic times for financial reasons, but also for a bigger reason:  since economic crisis leads to a significant rise in incidents of child abuse, it is more important than ever to aid in abusive head trauma prevention.  If you feel that this economy has led someone to neglect or abuse your child, contact Chris Keane for free answers to all of your questions and help recovering financial compensation for the care and rehabilitation that your child needs.  If you have any questions for a child injury and shaken baby syndrome lawyer who works as an advocate for injured and abused children, contact the Keane Law Firm so we can help you help your child.  1-888-592-KIDS.  (1-888-592-5437).

New Study Finds That Many People Guilty of Child Abuse Get "Off the Hook" in Court | Shaken Baby Syndrome Attorney

A new study has found that many people charged with child abuse for shaking babies and causing serious head injuries to children are "let off the hook" in court, according to MedIndia online.  The article reports that Dr. Amanda Stephens examined the cases of 68 children who received treatment for shaken baby syndrome in the child protection unit at Sydney's Children's Hospital at Westmead.  Upon examination of these cases, which occurred between 1997 and 2005, Dr. Stephens concluded that perpetrators are often "let off" due to the difficulty of identifying them.  In her own words, "if you don't know who did it" and cannot "make that decision," it can be extremely difficult to determine "whether that child should be returned to the family" or removed from the family.

Shaken baby syndrome (abusive head trauma) cases can be extremely complicated, requiring the expertise of an experienced child abuse and shaken baby syndrome lawyer.  There are unique focuses of child injury and abuse attorney Chris Keane that affect his success in shaken baby syndrome cases:  first of all, he focuses his practice on representing children and only children in cases such as this (enabling him to work with the best medical experts in the field).  Second, he represents injured children in civil cases of abuse or shaken baby syndrome, meaning that it is not necessary to prove that someone intentionally injured or shook a baby, but simply that they failed to care properly for the child.

If you have questions regarding a shaken baby syndrome incident, feel free to contact Chris Keane online or by phone at 1-888-592-KIDS, and he will consult with you for free regarding your specific situation and concerns.

As mentioned in many of the blog posts here on the Shaken Baby Syndrome Blog website, abusive head trauma (shaken baby syndrome) can lead to serious brain injuries for its victims.  Among the most serious forms of head injury is traumatic brain injury (TBI).  In order to educate the public about TBI, its causes and effects, medical symptoms, and how to receive proper care for TBI, Chris Keane is launching a new website devoted entirely to pediatric traumatic brain injury.  Check back to this site for links and updates on the status of the Child Brain Injury Blog.

As a shaken baby syndrome and child brain injury lawyer, Chris Keane devotes his practice to representing injured and abused children.  If you have questions for a legal advocate for injured children, feel free to contact Chris Keane at the Keane Law Firm.  He will provide you with the resources your child needs and consult with you for free regarding your unique situation.  1-888-592-KIDS.

Brain Injuries from Shaken Baby Syndrome

As an experienced shaken baby syndrome lawyer, Chris Keane is familiar with the serious effects of the condition, specifically brain damage and traumatic brain damage (TBI).  Due to rapid motion of the brain inside the skull, the brain experiences inflammation and even the bleeding and tearing of nerve fibers, which have resulted in permanent impairment or death.  To explain the details of shaken baby syndrome and its connection to traumatic brain injury, attorney Chris Keane has created a video highlighting the topics of concern.
